2:40 am in Legal by Rosaria

I read that news on yahoo, its kinda unusual news for me, the first grade elementary school girls fought and cause serious consequences. One of them ( Named MJ )  had to be hospitalized for seven days because of hip bones and vagina bones cracked.

This happened after MJ got pushed and kicked by her friend BM.  MJ was bleeding and was taken to Adi Husada hospital immediately. The victim family said the hospital was cost them about Rp27.273.800 during the treatment, MJ’s family bear their own costs assisted by the school.  MJ’s family had filed a demand for compensation to BM’s family but they refused that.

Joni Iwansyah as a legal adviser of MJ filed civil suits against  BM, “In this lawsuit we filed a compensation cost of care and continued maintenance costs for Rp27.273.800, 2000,” said Joni.

The civil suits already registered at district court Surabaya, with register number is 664/Pdt.G/2010/PN.

In the lawsuit described that was a fight between students of John Gabriel Elementary school ,occurred on February 25, 2010. During recess, BM who is IA student pushing MJ, IB student. MJ fell backward. In the supine position, then BM kicked MJ and left running into the classroom, MJ was in pain and bleeding.

The law suit been registered because the victim family not see the good will from BM family. I havent got further information yet from BM’ family about situation happens now or what their comments about this situation. But till now , MJ said she has pain every time she urinate.

Fight among students like this not the first case,  cooperation of all parties is needed to prevent widespread violence in a student environment. Communities, governments, families, teachers, as well as private institutions such as the TV station that sometimes show scenes of violence that many children imitated.

Indonesian Mothers To Face Jail Sentence For Refusing To Breastfeed

7:54 am in Legal by Rosaria

I read The Jakarta Post, edition, Tue, 08/10/2010 and the news was made me surprised. The goverment will enforce the rules about breastfeed, according to that articles the law will only be enforced on Oct. 13, 2010. And these are the articles of 2009 law health, which will manage the rules about breasfeed :

Article 128
(1) Each infant has the right to obtain breast milk exclusively for 6 (six) months since birth, except for medical indication.
(2) During the breast feeding period, the family, government, local government, and society shall support the mother fully by providing time and a special facility.
(3) Availability of special facility as referred by paragraph (2) shall apply to work places and public facilities.

Article 200

Each person who intentionally hinders the exclusive breast feeding program referred by Article 128 Paragraph (2) is punished by incarceration for a maximum of 1 (one) year and fined a maximum amount of Rp100,000,000.00 (one hundred million rupiahs).

Pro and contra come about this. This law will protect babies right to get the breastmilk, but how about mother, breastfeeding does not always come naturally, plus it is painful during the first weeks. And after baby birth the women already tired mentally and physically. Now women have to face the prison too, it will be more stress for them after baby birth, and that stress not good for the mother and the baby. No need to threat a mother by punishment.

Being a mother its very hard, but a mother, I think they know what the best for their babies, including the breastfeed things. Is that really necessary to put that into the law. And what if the mother refuse to breastfeed their baby and they go to prison, who will breastfeed the baby ? Will the baby go to the jail too ?

Breastfeeding supposed to be free choice, I agree mother should breastfeed their babies, because they love their babies and want to sacrifice for them, not because they are afraid of punishment and have to obey the law.
